Trump's Anti-Immigrant Rhetoric Was Never About Legality — It Was About Our Brown Skin

Now Trump’s rhetoric has turned deadly as well. On Aug. 3, a white nationalist opened fire in a crowded Walmart in El Paso as “a response to the Hispanic invasion of Texas,” he wrote in a manifesto prior to the shooting. The shooter didn’t stop to ask any of the 22 people he killed for their papers, or if they came to the U.S. “the right way,” or if they immigrated “legally.” That’s because it isn’t actually about legality. It is about our brown skin in America.

My latest for Crooked Media: The ACLU has sued on Mr. Torres’s behalf so that the courts might recognize these types of actions as racial profiling, which is already illegal and unconstitutional. But Torres’s terrible saga demands us to examine what happens to undocumented people when they are detained by local authorities. Had Mr. Torres been in the country illegally, the Ascension Sheriff’s Office would have turned him over to ICE and he’d likely be sitting in a crowded detention camp right now, if he were not already deported.

We are in the midst of what is undeniably a humanitarian crisis. ICE is holding a record 50,000 migrants in detention facilities across America, the agency reported in May, and while McAleenan has denied that children were held in unhygienic conditions, he has admitted that this is an “extraordinarily challenging situation.” The Antideficiency Act allows federal agencies to accept voluntary services “in cases of emergency involving the safety of human life or the protection of property.” The safety of human life is exactly what is at stake here: At least seven children have died while in U.S. custody since last year. “The administration could invoke the emergency exception in the Antideficiency Act,” Mukherjee told me. “It doesn’t have to be this way. This isn’t a matter of the law. It’s about cruelty.” Whether or not you believe that our country should have to depend on charity to take care of those within its borders, the need is real.
